1. Agreement

1.1 In these Terms and Conditions We, Our or Us means UCOM Telecom; and You or Your means the person who accepts these Terms and Conditions by using this Website and associated software, networks and processes, including the purchase of Products or Services through the Website and associated UCOM Telecom websites.
1.2 By browsing the Website, or placing an Order, You agree to these Terms and Conditions, which constitute a legally binding Agreement between Us and You for the supply of Products or Services.
1.3 The Agreement together with Your Order constitute the entire agreement between Us and You for the supply of Products or Services. The Agreement cannot be varied unless We agree to vary it in writing or by email.

2. Legal Capacity

2.1 If you are under the age of eighteen (18) years you cannot place Orders with UCOM Telecom. By accepting this Agreement, you acknowledge that you are over the age of eighteen (18) years.

3. Website Use

3.1 The Website may contain links to other websites. Those links are provided for convenience only and may not remain current. We are not responsible for the content or privacy practices of linked websites.
3.2 You must ensure that Your access to, or use of, the Website is not illegal or prohibited by laws which apply to You.
3.3 You must take precautions to ensure that accessing the Website does not expose You to viruses or malicious code. We take no responsibility for any such damage.

4. Pricing

4.1 All prices listed on the Website exclude Delivery Costs, shown separately on Orders.
4.2 Prices displayed on the Website are subject to change without notice. Once an Order has been accepted and a Purchase Contract formed, the price cannot be varied except:
    (i) by agreement in writing; or
    (ii) in accordance with clause 7.d.

5. Product Specifications

5.1 Features and specifications of Products are subject to change without notice. Once an Order has been accepted, We will not materially change the specifications.
5.2 All weights and dimensions are approximate.

6. Orders

6.1 You may place an Order by following the instructions on the Website. By placing an Order, You make an offer to purchase the Product(s).
6.2 Orders will be deemed received by UCOM Telecom when an Order confirmation is sent to Your nominated e-mail address.
6.3 UCOM Telecom communicates primarily via e-mail. It is Your responsibility to ensure contact details are correct and e-mail is regularly checked.
6.4 UCOM Telecom reserves the right to decline or cancel Orders prior to dispatch. Cancelled Orders will be refunded in full.
6.5 We are not responsible for Orders declined or delayed due to internet disruptions.
6.6 We are not liable for delays caused by factors beyond our control.
6.7 Incorrect or incomplete delivery addresses may incur redelivery fees.

7. Payment

7.1 UCOM Telecom accepts payment by Credit Card, PayPal, and Direct Bank Deposit.
7.2 Credit Card and PayPal payments are processed immediately upon confirmation of the Order.
7.3 Direct Bank Deposit payments must be cleared within 7 days before dispatch.
7.4 Fraud prevention protocols may apply; failure to provide requested information may result in cancellation.
7.5 Pricing errors:

  • If the correct price is higher, We may contact You to confirm or cancel.
  • If the correct price is lower, We will charge the lower price or refund any difference.

8. Delivery & Ownership of Goods

8.1 We aim to deliver promptly, but delays may occur outside our control.
8.2 Dispatch dates are estimates only. Delays of more than one week will be notified by e-mail.
8.3 UCOM Telecom does not deliver to PO Boxes.
8.4 Written authority for delivery without signature voids insurance.
8.5 Couriers deliver during business hours (Mon–Fri, excluding public holidays).
8.6 Once Products are dispatched, Customers must liaise with couriers directly.
8.7 UCOM Telecom may decline to ship to remote locations.
8.8 Title and risk pass to You at dispatch.

9. Faulty or Damaged Goods

9.1 UCOM Telecom will replace or refund faulty or damaged goods in line with our Warranty Policy and rights under Australian Consumer Law.

10. Refunds & Returns

10.1 Nothing in these Terms excludes consumer guarantees under Australian Consumer Law.
10.2 Refunds may take up to 10 business days.
10.3 Refunds are limited to statutory entitlements and our Returns Policy.
10.4 Customers must comply with staff directions for returns.
10.5 Returned Products must be in original packaging with all accessories, unless returned under statutory guarantees.
10.6 Customers are responsible for safe return transit; We are not responsible for items lost in transit.
10.7 Costs of return are borne by the Customer unless the return is due to our failure to comply with consumer guarantees.

11. Warranties

11.1 Each Product is covered by a 12-month Standard Warranty.
11.2 Statutory warranties and guarantees also apply.

12. Liability

12.1 To the extent permitted by law:

  • We are not liable for indirect or consequential loss (e.g., profits, contracts, data).
  • Our aggregate liability will not exceed the purchase price of the Product(s).
    12.2 This does not limit Your statutory rights under Australian Consumer Law.

13. Intellectual Property

13.1 All intellectual property in material on the Website is the property of UCOM Telecom.
13.2 You may not reproduce, adapt, modify, display or distribute material unless expressly authorised.

14. Privacy

14.1 By placing an Order or contacting Us, you consent to UCOM Telecom storing and processing data for Order fulfilment.
14.2 We may use data (excluding credit card details) to provide information on other UCOM Telecom products of interest.
14.3 You may request a copy of data held by Us, subject to an administration fee. Incorrect data will be corrected upon written request.
14.4 Please refer to our Privacy Policy.

15. Gift Vouchers

15.1 Gift Vouchers & Credit Notes are valid for 12 months unless otherwise stated.
15.2 They may be redeemed at checkout by entering the voucher code.
15.3 Gift Vouchers are not refundable.

16. Miscellaneous

16.1 UCOM Telecom reserves the right to amend these Terms and Conditions without notice. Changes apply prospectively only.
16.2 Any unenforceable provision may be severed without affecting remaining provisions.
16.3 Failure to exercise a right does not constitute a waiver.
16.4 These Terms are governed by the laws of Victoria, Australia, and disputes are subject to Victorian courts.
16.5 No UCOM Telecom employee or agent has authority to vary these Terms.
